The legal battle involving former Forum for Democratic Change (FDC) leader Dr. Kizza Besigye has taken another twist after his lawyer, Kampala Lord Mayor Elias Lukwago, returned to the High Court with fresh applications seeking the recusal of Justice Emmanuel Baguma from all Besigye-related cases.
Lukwago told court that his clients, Dr.Kiiza Besigye and Obed Lutale, currently on remand at Luzira prison, have instructed him not to proceed with any hearing before Justice Baguma.
This is the second time Lukwago and his team is asking the judge to step aside, arguing that his continued involvement undermines their clients’ confidence in the trial.
However, State Prosecutor Richard Birivumbuka dismissed the move as an abuse of court process, noting that the judge had already ruled on the matter and given reasons why he would not withdraw from the cases.
He urged the court to dismiss Lukwago’s application.
In his ruling Justice Baguma reaffirmed his earlier stance, directing that the bail application will proceed on 08 October,2025.
He also issued a production warrant compelling Luzira prison authorities to present the two suspects in court on that date.
However Lukwago insisted that Dr Besigye will not appear in Court if judge Baguma does not step aside
