The High Court in Kampala has dismissed an application seeking the unconditional release of two Kenyan nationals, Nicholas Oyoo and Bob Njagi, who allegedly went missing during an NUP presidential campaign in Eastern Uganda.
Justice Simon Peter Kinobe ruled that there was no evidence showing that the two men were being detained by the Uganda People’s Defence Forces (UPDF), the police, or any intelligence agency as claimed by their lawyers, families, and activists.
The ruling followed an application filed by lawyers representing the two Kenyans, who were reportedly abducted on October 1, 2025, in Kaliro District while attending a campaign rally for NUP presidential candidate Robert Kyagulanyi.
Affidavits by Koffi Atinda, a friend, and David Lewis Rubongoya NUP Secretary General, claimed that the duo was picked up by armed men in both military and civilian clothes and driven away in a Toyota Hiace “drone” van before being detained at a military facility in Mbuya.
However, the Chief of Defence Forces, Chief of Defence Intelligence, and the Inspector General of Police denied holding them, saying no records of their detention were found in any security facility.
Justice Kinobe noted that state agencies had complied with his earlier order to produce the two men dead or alive, but found no proof linking security agencies to their disappearance.
He dismissed the application, stating that “the State can only produce what it has.”
The judge directed the applicants’ lawyers to file a missing persons report with the Uganda Police Force to enable formal investigations into the whereabouts of Oyoo and Njagi.
